1. Agreement to Terms

By accessing or using the website therecoverymachine.co, the Recovery Machine mobile application, or any services provided by The Recovery Machine LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services. These Terms constitute a legally binding agreement between you and The Recovery Machine LLC.

2. Description of Services

The Recovery Machine provides mobile recovery services delivered directly to your location in and around Orange County, California. Our services include but are not limited to:

• Cold plunge therapy
• Finnish sauna sessions
• Red light therapy
• Combination recovery packages
• Event and group recovery sessions

Services are delivered via our fully equipped mobile recovery unit that travels to your specified location. Service availability is subject to scheduling, geographic coverage, and equipment availability.

3. Eligibility

You must be at least 18 years of age to use our services. By booking a session, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. Minors under 18 may participate in recovery sessions only with the written consent and physical presence of a parent or legal guardian.

4. Bookings and Scheduling

All bookings are subject to the following conditions:

• Advance Notice: Bookings require a minimum of 24 hours advance notice.
• Operating Hours: Sessions are available 7 days a week, 8:00 AM to 6:00 PM Pacific Time.
• Session Duration: Standard sessions are 60 minutes in length.
• Service Area: Services are available within our designated service area. Locations beyond our standard radius may incur additional travel fees.
• Confirmation: All bookings are subject to confirmation. We reserve the right to decline or reschedule bookings based on availability.

5. Cancellation and Refund Policy

• Free Cancellation: Cancellations made more than 24 hours before the scheduled session will receive a full refund.
• Late Cancellation: Cancellations made within 24 hours of the scheduled session may be subject to a cancellation fee of up to 50% of the session price.
• No-Shows: Failure to be present at the scheduled time and location will result in a full charge for the session.
• Weather: In the event of severe weather conditions that make service delivery unsafe, we will reschedule your session at no additional cost.

Refunds are processed through the original payment method and may take 5–10 business days to appear on your statement.

6. Pricing and Payment

All prices are listed in US dollars and are subject to change without prior notice. Payment is required at the time of booking unless otherwise agreed upon. We accept payments through Stripe and other payment methods displayed at checkout.

• Memberships: Monthly membership plans are billed on a recurring basis. You may cancel your membership at any time, effective at the end of the current billing cycle.
• Promotional Offers: Discount codes and promotional offers cannot be combined unless explicitly stated. We reserve the right to modify or discontinue promotions at any time.
• Travel Fees: Additional charges may apply for locations outside our standard service radius.

7. Health and Safety Disclaimer

Our services are not a substitute for professional medical advice, diagnosis, or treatment. You should consult with a qualified healthcare provider before using cold plunge, sauna, or red light therapy services, especially if you have any of the following conditions:

• Cardiovascular conditions or heart disease
• High or low blood pressure
• Pregnancy
• Epilepsy or seizure disorders
• Open wounds or recent surgical procedures
• Any condition that may be adversely affected by extreme temperatures

By using our services, you acknowledge that you have disclosed any relevant medical conditions through our intake form and that you participate at your own risk.

8. Assumption of Risk and Liability Waiver

You acknowledge that cold plunge therapy, sauna use, and red light therapy involve inherent risks, including but not limited to dizziness, fainting, burns, hypothermia, and cardiovascular stress. By booking and participating in a session, you voluntarily assume all risks associated with the services.

To the fullest extent permitted by law, The Recovery Machine LLC, its owners, employees, and contractors shall not be liable for any injury, illness, damage, or loss arising from your use of our services, except in cases of gross negligence or willful misconduct.

9. Intellectual Property

All content on our website and application — including text, graphics, logos, images, videos, and software — is the property of The Recovery Machine LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

10. User Conduct

When using our services, website, or application, you agree not to:

• Use our services while under the influence of drugs or alcohol
• Misrepresent your health status or medical conditions
• Damage, tamper with, or misuse our equipment or mobile unit
• Harass, threaten, or behave inappropriately toward our staff
• Use our website or application for any unlawful purpose
• Attempt to gain unauthorized access to our systems or data

We reserve the right to refuse service and terminate your account for any violation of these Terms.

11. Referral Program

Our referral program allows you to earn rewards by referring new clients. Referral credits are subject to the specific terms of the referral program as displayed on our website. We reserve the right to modify, suspend, or terminate the referral program at any time. Referral credits have no cash value and cannot be transferred or sold.

12. Third-Party Services

Our website and application may contain links to third-party websites or services (e.g., Stripe for payments, Apple App Store). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies.

13. Limitation of Liability

To the maximum extent permitted by applicable law, The Recovery Machine LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of our services, website, or application. Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the specific service giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless The Recovery Machine LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Orange County, California.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
